Privacy policy

1. General and legal basis

Protecting your personal data matters to me. This policy explains which data is processed when you visit ooertle.ch. It is based on the Swiss Federal Act on Data Protection (revFADP, in force since 1 September 2023).

3. Hosting and server log files

This website is hosted by green.ch AG, Lupfig, in Switzerland. When you open a page, the server automatically stores technical data in log files:

• IP address
• date and time of access
• page and file requested
• browser type and version, operating system
• referrer URL (previously visited page)

The data is used for secure and stable operation and for error analysis. It is kept only as long as needed for these purposes and then deleted or anonymised automatically; longer only if it is needed to investigate abuse. The hosting provider acts as a processor.

4. Fonts, videos and embedded posts

Fonts and the website's own videos are delivered from my own server. No fonts are loaded from Google Fonts or other external providers.

Some project pages contain embedded third-party posts from Instagram (Meta Platforms Ireland Limited, Ireland; Meta Platforms, Inc., USA) and VK (VK Company Limited / VKontakte, Russia). When you open the page you only see a preview image from my server; no connection to the provider is made. Only when you click the post is it loaded directly from the provider. The provider then receives in particular your IP address, browser and device details, the page visited and the time. The provider may set cookies and recognise you, especially if you are logged in there, and processes the data under its own terms.

Data may be transferred abroad: for Instagram to the USA (Meta is certified under the Swiss-U.S. Data Privacy Framework), for VK to Russia, where data protection is not comparable to Switzerland's. By clicking you expressly consent to this transfer (Art. 17 para. 1 lit. a FADP). If you don’t want this, just don’t click; the website remains fully usable. Inside the loaded player, further links may lead to the provider's pages.

5. Contact (email and contact form)

If you email me or use the contact form, I process the details you provide: name, email address and your message, plus the date and time of the request. The form is sent by SMTP via my own mail server as an email to my mailbox. No database stores form entries.

I use the data only to answer your request. It is not passed on to third parties and is deleted no later than 6 months after the request is closed, unless statutory retention duties apply. The legal basis is your request and my legitimate interest in answering it. Please note that emails can be transmitted unencrypted over the internet.

6. Personalised links in application documents

In my application documents I use links with a random code (addresses of the form ooertle.ch/p/…). When such a link is opened, I store the code, the time and the target page to find out whether an application has been viewed. The code contains no information about you or your company. No IP address or browser details are stored and no cookies are set. The data is deleted after 12 months. The legal basis is my legitimate interest in tracking my applications. You are then forwarded to the website; the parameters in the link (utm_…) reach Google Analytics only if you have consented there (section 10).

7. WhatsApp, Telegram and Threema

The website has a button that opens a chat via WhatsApp Business (wa.me link). Merely visiting the website does not send any data to WhatsApp. Only when you click the button does WhatsApp open, and data such as your phone number, your message and technical details are processed by WhatsApp Ireland Limited or Meta Platforms, Inc., including in the USA. WhatsApp's privacy policy applies: whatsapp.com/legal/privacy-policy-eea. If you prefer not to, write to me by email.

The same applies to the links to Telegram and Threema (Threema GmbH, Switzerland): merely visiting the website sends no data; only after a click does the respective service open, and its privacy policy then applies. In the contact form you may optionally choose a reply channel and enter your WhatsApp number, Telegram username or Threema ID. I use this detail only to reply to you there; like the other form data it is delivered by email and deleted together with the enquiry.

8. External links (LinkedIn, Instagram, VK, others)

The website contains links to my LinkedIn profile, to Instagram and VK pages and to individual external articles (e.g. the “Best of St. Gallen” article in the online magazine at miplan.ch). These are plain links: data is transmitted only when you click a link. After that, the provider's privacy policy applies. I have no influence over their data processing.

9. Cookies and consent

On your first visit a cookie notice appears. Your choice is stored in your browser (local storage) so the notice does not appear on every visit. Analytics cookies (Google Analytics) are set only after you agree. You can change your choice at any time via the “Cookie settings” link in the footer. Instagram and VK videos do not depend on this choice: they load only when you click a video, even if you declined cookies (section 4).

10. Google Analytics

With your consent I use Google Analytics 4, a web analytics service of Google Ireland Limited, Ireland (Google LLC, USA, as a further recipient). It helps me understand how the website is used. Data may be transferred to the USA; Google is certified under the Swiss-U.S. Data Privacy Framework. Google Analytics 4 does not store IP addresses. The legal basis is your consent (Art. 31 revFADP), which you can withdraw at any time. More information: policies.google.com/privacy. Browser add-on to opt out: tools.google.com/dlpage/gaoptout.

11. Disclosure to third parties

I pass on personal data only if you have consented, if I am legally obliged to, or if service providers act on my behalf (e.g. hosting, mail server). The providers named above (Google, WhatsApp/Meta, Instagram/Meta, VK, LinkedIn) receive data only as described, as a rule only once you agree or click.

12. Your rights

Within the applicable law you have the right to access, rectification, erasure, restriction of processing, objection, data portability, and to withdraw consent with effect for the future. Write to hello@ooertle.ch. I may ask for proof of identity.

You may also complain to the Federal Data Protection and Information Commissioner (FDPIC).

13. Changes

I may update this policy when the website or the law changes. The version published here applies.
